  • In June 2020, Washington repealed its statutory provisions that required HIV testing for individuals convicted of a sex offense.
  • Jail detainees and correction facility inmates can be tested if the jail administrator (with the approval of the local health officer) for jail detainees or the chief medical officer of the department of corrections (or their designee) for inmates determines that there is an exposure risk.
  • Certain employees (e.g., law enforcement, firefighter, heath care staff, jail staff) at risk of exposure can request a state or local health officer to order testing and can request a court hearing if the request is denied.
