In such cases, the charges may be dismissed if the defendant demonstrates that a pre-indictment delay causes substantial prejudice to his or her right to a fair trial and that the delay was intentional to gain a tactical advantage. Although Wyoming has no statute of limitations for any criminal offense, due process concerns may arise when delay in bringing charges results in prejudice to a defendant.
